AM I ELIGIBLE TO APPLY UNDER EUROPEAN LAW?

Post by oraake » Mon Jan 11, 2010 2:28 am

This question is being asked on behalf of a loved one.

The party in question is presently on a tourist visa and her unmarried partner (EU CITIZEN) is offering to make an EEA2 application for her.

The tourist visa is still valid. We want to know if this is possible or would she need to apply from her country of residence/origin?

Please reply.

Thank you

As long as he is exercising his treaty rights, and they can show that they have been in a subsisting relationship for 2+ years, then she can apply as an 'extended family member' on form EEA2 from within the UK, while on a tourist visa.
