Can i apply for Permanent resident?

Post by assbc » Mon Feb 15, 2010 8:59 pm

My friend has been living here in ireland for 3.5 years on stamp4 because his married to an Irish national, but he would not want to apply for Naturalization, is there anyway he can apply for permanent resident when his GNIB expires? His still together with his wife.

Long Term Residency = 60 months residency either on Stamp 1. However! look at the INIS website, Long Term REsidency is only available to people on Stamp 1. You already have stamp 4. Long Term REsidency give you stamp 4, you already have this. The department clearly state that it does not apply to Spouse of Irish Nationals. Requesting for further residency you need to contact SPouse section, who may have discretion in granting you for a period of further length, assuming that your friend is STILL living with the wife and marriage is subsisting. At least with the Stamp 4 your friend has got, he need not be too worried if he is out of work as their won't be on condition for renewal. I think going to the GNIB is all that is needed to renew here (bring spouse) Make sure renewal is done on time

if marriage breaks down department needs to know, don't worry if relationship was valid for at least 2 years and genuine and/or children involved, friend should be ok

He could after, 8 years apply for residency without condition as to time

chances are that at the next renewal (all going well) your friend may be given 5 years on stamp 4
