URGENT! HSMP Extension - Application tomorrow 22 Feb 2010

Dear All,

PLEASE!!! I need to clarify this ASAP!!!!

I'm having a problem with the maintenance funds requirement for my HSMP extension application.

My visa expires on 24th April 2010. And I WAS thinking to apply for the extension closer to this date.

HOWEVER my account balance went down £ 800 from 21 Jan 2010 to 19 Feb 2010 (28 days).

SO I couldn't use anymore these bank statements (Jan/Fev 2010) for the maintenance funds if I would make the application on April 2010.

Trying to find another solution, I've started to search the internet and I just found out , minutes ago, about the about the "The letter must be dated no more than one calendar month before the date of application" rule!!

Before I thought that the statements should cover the period exactly prior the date of the application only. I didn't know it could be one calendar month!!!

THEN I realized that I can still apply and send the statements from Nov 2009/Dec 2009/Jan 2010, where my account has been over £1000 pounds at all times.

My question is : Today, Sunday, 21 Feb 2010 is exactly one calendar month!

If I apply this tomorrow Monday 22 Feb 2010 (Special Delivery Royal Post) I will be only 1 day over the one month calendar rule.

Do you think I still have a good chance?!?

Will this only 1 day over the 'one calendar month' rule be a big issue for the approval?!?

PLEASE! PLEASE PLEASE! I need some advices ASAP!

I have ALL THE DOCUMENTS ready to go! And tomorrow, Monday morning 22 Feb 2010, I am also going to the bank to get a official letter confirming that I had the minimum £800 over that period!

I just would like to know if I need to know which chances I have and if there's anything I can do to make it happen!!!!

Please senior members, solicitors, anyone help me asap!!!

No, because you are not within the "one month limit".

But do you also agree that I have missed the 'one month calendar' for just one single day?!?

Do you think they wouldn't take that in consideration?!?

My other approach would be to wait until April 2010 to make the application and include the Jan and Feb 2010 as part of the proof for the maintenance funds. However, as I mentioned before, my balance went down £800 on these months.

What do you think?!?

You have just answered your question.
But do you also agree that I have missed the 'one month calendar' for just one single day?
The rules are made to abide by and why do you think that they would consider even one day? Especially when the Govt is trying to bring down immigration.
They would not consider the maintenance fund if it is less than one penny for even one day. So why would they consider one day more than the calender month.

WOW! That's really bad news for me then!

I've been the whole day and night searching for any solution...

I just can't see a solution right now... my head hurts.

Please remember that you can show ur maintenance funds in combination of 1 or more accounts in ur name or as a joint accounts in or Out of UK bank accounts and see if your low funds days can be filled with other accounts..

I was checking my other bank accounts and it seems I have a good chance now!!!!

On 21 Jan 2010, my account(Barclays) balance was £ 700.00 - so at this date it went below £800 pounds.

However on the same date 21 Jan 2010, I have £ 120 pounds available in other account(HSBC).

So all together on that date I still had available £ 820!!!

And situation was like this until 31 January 2010 - after that the balance went even higher.

So I did have £820 available thoughout the month of January 2010.
(£700 pounds at Barclays + £120 pounds at HSBC)


So if I make the application tomorrow 22 Feb 2010 or until the end of this week, these dates would still be within the 'one month calendar', right?!?

I start to see a light in the end of the tunnel, but I would like to share this before I get any excited.

Please advise ASAP!!!!

Well you are lucky then, if you had minimum of £820 in both the accounts at all times, you are good to go, but ensure that you mention this in the cover letter (£700 in one account + £120) in another account.

just double check the same that you are never below the min 800gbp required;

and mention/explain the same in the cover letter..

once you did that u are good to go ahead

I am little confused in the above quote you are saying/talking about jan 2010 but in ur first message you mentioned;
my account balance went down £ 800 from 21 Jan 2010 to 19 Feb 2010 (28 days).


don't miss anything, did the 19days in feb is also covered?

Just to clarify what I've said, I am considering the 'one calendar month' rule.

For example, if I apply tomorrow 22 Feb 2010, the latest date on my bank statement that I can present is 22 Jan 2010 - (one calendar month ago).

I read the following response from the Home Office in another thread:

"For further clarification, if you applied on the 29 January 2009 then the largest gap we could allow before the assessment period would be one month and thus we could go back to 29 December for the start of the 3 month assessment period. "

Is that right?!?

From this rule I understand that I'm allowed to send the bank statements for the following dates:

23 Oct 2009 - 22 Nov 2009
23 Nov 2009 - 22 Dec 2009
23 Dec 2009 - 22 Jan 2010

Going back to 22 Jan 2010 "for the start of the 3 month assessment period. "

Please let me know ASAP if I have misunderstood something!!!

Please don't make multiple posts on the same topic.

If you can show maintenance funds of 800 pounds EOD balance on each day from 22-Oct-09 to 22-Jan-10 (both days included), then you can apply (latest) by 22-Feb-10.

As advised, you can use more than 1 account to show availability of funds. No problem in that.

Hope this clarifies all doubts.
