A number of comments. Firstly, why all that evidence? Have you actually read the requirements, as stated on the SET(M) form?

As regards the first two questions :-
  1. The items you mention, they are not within the definition of Public Funds, as in para 6 of the Immigration Rules. So no problem as regards the ILR application.
  2. As regards HiPG, that is not within the definition of Public Funds, and UKBA are being very naughty even including it on the form. Admitting you receive the other benefits you mention will not cause a problem, given that the applicant is married to a British Citizen.

Bearing in mind that each case is different, my wife was granted ILR on 4/3/10, only a few days ago.
We took as much documentation as possible to err on the side of safety.
The officer took both passports, the passport sized photos, bank statements and the Life in the UK certificate.
Process took less than an hour.
I think it is normal to stress out at the process of claiming ILR as it is a very important step in your life.We amassed plenty of documentation to present to the Home Office but was never even looked at

health in pregnancy grant

Post by afshaan » Fri Mar 19, 2010 10:43 am

can i get the Health in pregnancy grant while on spouse visa married to british citizen without jeopardising my ILR that I'll be applying for in Aug 2010..?

it says on my visa 'no recourse to public funds'

afshaan, you need to appreciate that not every type of benefit is within the definition of Public Funds as in para 6 of the Immigration Rules.

Having made that clear I shall now talk of the incompetence of UKBA as regards this matter. That is, whilst forms such as the SET(M), which you will complete, mention HiPG, and indeed ESA, under the heading of Public Funds, the fact is that neither HiPG and ESA, both comparatively new benefits, have yet been added to the definition of Public Funds.

And just yesterday, in order to force home the sheer incompetence of UKBA in this matter, numerous changes to the Immigration Rules were announced. Indeed the change document has no less than 17 pages of detailed changes, but did they take the opportunity to add the two newish benefits to the definition of Public Funds? No!

As regards HiPG there is also another problem for UKBA, even if HiPG is added to the Public Funds definition, the Public Funds question on forms such as the SET(M) is in the present tense ...... are you receiving .... and not in the past tense .... have you received.

So whilst all the other benefits within the Public Funds definition are benefits paid for a continuing period ..... such as every week .... HiPG is paid as a one-off, well one-off per pregnancy. So unless it happens to be the case, when someone is filling in the form such as the SET(M) , that someone has just claimed, but not yet received, the answer to the present tense question as regards HiPG ..... are you receiving ..... is bound to be "no"!
