Asylum seekers legacy cases
Hi to every one .

I would like some information about this legacy cases wish I heard about it from a lot of people who are close to me.

Firstly I am Algerian originally and I came to the uk in February 2000 and I applied for asylum seekers, and after 2 years they refused my application.

Since then I am staying in the uk illegally and I have never been in jail or have any criminal record or been prosecuted in the past 10 years. Well the life its very hard when you are illegal and that affect me mentally from few years ago as you cannot have your right like another people.

Lately I have heard that I can apply for legacy case under human right and that because I have been in uk for 10 years but I am very confusing what to do or even if it’s a truth what I heard or no, and few days ago I got in touch with solicitor and she advice me that I can apply for legacy case and she ask me if you have family in uk and that will help a lot , well I do have a brother and he’s holding a British citizen passport but I am still confusing what do even with her advice or I can say I am bit scared to get in touch with home office again as I always think about negative more then appositive.

And I heard that those legacy cases will end in 2011 and she advice me to apply before the dead line.

Please to everyone who knows about it ( legacy cases ) or he think that I am eligible to apply even if my asylum seeker is not been accepted along years ago can advice me what’s the right for me to do by law

Have you any reason to think that your solicitor has not advised you honestly? If not, your course is clear. You may be scared to contact the Home Office, but nobody else can give you permission to stay in this country.

I was too scared to submit my application to the Home Office/UKBA because I thought instead of considering my application they would instantly deport me. It takes a lot of courage to take the next step and it's a difficult journey. But if it means the end of living a lie then you should do it. You soon could have your freedom!


The advice your solicitor has given you is the exactly same my solicitor gave me. It's sound advice. Having family connections in the UK is a positive, especially as it is a brother.

Take the leap, you have nothing to lose. :D

You definetly fall in legacy cases, provided that you have no criminal record. I know one of case where both wife and husband were here since 1999 but quit signing on and were detained and later on deported back. Legacy exercise is not only to grant but is to solve the pending cases. If you can prove that article 8 is engage and you have family life in the UK than you have chances to get ILR, you must c the solicitors.

Thanks for all of you , but what makes me worries is if I got refused ?? The solicitor said u can appeal against the decision to the tribunal but what about if u got refised again , well its good to think about positives but better to get ready if u face negatives

And I want to ask zaryaab what he means if I can prove that article 8 is engage and you I family life in the UK ( what do u mean about article 8 )

Article 8 of the Human Rights Act is used by people who have no other hope and is used as a money making exercise by lawyers who have no scruples.
YOU CAN EXERCISE THIS RIGHT TO A FAMILY LIFE IN YOUR OWN COUNTRY UNLESS IT IS DANGEROUS TO DO SO

So what’s the next step ? So do u think my solicitor will ask the home office to send her a legacy questionnaire form then what’s next ? So I have to have see her to fill up the form or she will do it alone ?

Hi everyone, i just want to ask about this legacy of a thing,my solicitor told me that i can apply for it ( i.e Legacy) and i have apply for it since october but ever since i have never had anything from them(*Home Office). Also i have sent my child's birth certificate still i have not hear anything from them. I heard that if you apply for legacy they will respond within three weeks. Could anyone tell me if they have similar situation as mine?
