Doubt about 2nd Extension !!!!!!!!!

Doubt about 2nd Extension !!!!!!!!!

Dear all,
Last week, I have got my passport back with Tier-1 Extension for next 3 years .

Now I am bit confuse about what I have to do next.
I had got my HSMP visa on 13-March-2008 and enter to UK on 27-April-2008 after 45 DAYS.

According to current rule DO I need to apply for 2nd extension or direct to ILR??????

Any reply or comment much appreciated !!!!

You will have to go for 2nd extension (according to my understanding)

I may also fall in the same situation

My HSMP visa is valid from 02nd May, 2008 till 02nd May, 2010 and I applied for my Tier1 General Extension. I entered UK on 19th July, 2008. So from the above post, hope I may also need to go for second extension. But my question now is

HSMP Visa - 02nd May, 2008 to 02nd May, 2010 (Entered UK on 19th July, 2008)
Tier1 Extension - 02rd May, 2010 to 02nd May, 2013 (Applied, Waiting for approval)
Tier1 Extension ??? - Need to apply as I entered UK after 28 days initially on HSMP

When I am applying for ILR do I need to wait till my 2nd extension reaches its expiry date? as I should not apply for ILR until I have 28days for expiry of current visa?

Please clarify my doubt.

U HAVE crossed 28 days time line , margin allowed by HO TO enter UK

why not??
HO procedure allows only 28 days time period to enter from date of visa stamp

and withIN 28 days of completion of 5 year applicant need to apply for ILR

Agree to Sushil
He's 2 months and 17 days short of qualifying 5 years. HO wouldn't allow you to be short of 5 years by anything more than 28 days

Thats true but, devendranadh.b was asking about 2nd extension. One can fulfil the requirement of 5yrs after the second extension and can apply for ILR as soon as he fulfils the requirement and he doesn't have to wait till the expiry of his second extension. What do u say?

Hi,

I agree with all of you. I need to go for 2nd Extension after 02nd May, 2013 which would be again for 3 years. so In total it would be 8 years (2+3+3).

My question is as soon as I complete my 5 years can I apply for ILR?

oh should have read that. No he doesn't have to wait for the expiry of his 2nd extension. He can apply for ILR as soon as he reaches 5 years or 4 years 11 months.
Just realised that I am 24 days short. Nice little window of 4 days to apply for ILR lol

Currently, My age is 30 and after 3 YEARS I wouldn't able to claim my AGE points.

What about rule of AGE point ???? as it will be the same as i have got my 1st extension ???

I haven't submitted IELTS during my Initial Application.
At the time of 1st Extension , I have Submitted IELTS with 6.5 Band.

Now, My Question is

DO I need another IELTS certificate for my 2nd Extension (because current one will be get expiry with in 2 YEARS and this shouldn't be valid for my 2nd extension) ????

There is a way to address the shortage problem, if the gap is small, by appling for the 1st extn very close to the expiry date. Typically home office takes around 2-3 weeks to process the application and the extnsion is valid from the day they approve it. In effect you can manage a gap of of 28+ (10 to 15) days if you are lucky.

I do not think they always give 3 years from the date of Stamping. I know a WP/Tier 2 extension case where even though the FLR was issued after the expiry, the visa was valid for 3 years from the date of the current expiry.

Please see post under Tier extn from one member. For Tier 1 looks like the visa is not backdated.

This case is exception. Usually visa is extended for 3 years from the expiry of your last visa regardless of the application date.
