Hi guys,
Need guidance on HSMP/Tier1 extension and conflicts about new rules of 6 April 2010.
HSMP Application Details/History
HSMP Approval: 21 January 2008
Applied for Entry Clearance: 20 June 2008
Rejection of Entry Clearance: 21 July 2008
Applied for Appeal: 13 August 2008
Appeal Allowed: 30 June 2009
Visa Stamped: 26 October 2009
Visa type on passport: Highly Skilled Migration Program
Visa Valid from 26-10-2009 to 26-10-2012 (Three Year Visa)
My questions are:
After 31 March 2009 they gave me 3 year visa as per rule of tier1 but they didn’t mentioned Visa type as Tier1 – General but they Mention visa type: Highly Skilled Migration Program.
I’m also confused about this point in my case as I got visa after 31 March 2009.
1. Points for a Bachelor degree and/or earnings under £20,000 will not be available for those who were previously granted leave under Tier 1 (General) on or after 31 March 2009.
Question1: Is the above statement means I need to have master's degree to apply for extension?
Question2: under £20,000 rule will also apply in my case for extension.
2. Age bandings will be one year lower for those switching from the Highly Skilled Migrant Programme (Over 34; 32 to 33; 30 to 31; 29 or under) due to the shorter initial period of leave that was granted to applicants in this category.
Question1: I got 3 year visa what age band would apply for extension after 3 year as I got 3 year visa initially.
Please clarify and would appreciate your swift response.....
Thanks,
Sana
