ILR 10 years confusive

hi, on feb 4 2013 iam finishing my 10 years life in UK to apply for long residence. I feel iam bit confused with this, coz iam going to put my PSW in JAN 2011 and that will cover upto jan 2013, but according to immigration rules i can apply before 28 days but how will i apply if my PSW visa finishes on jan 25 th 2013 ? wont they put me a query that if at all iam applying under that 28 days period, but i have not covered 10 years ?
