after 5 yrs residence permit can i apply for citizenship???

Post by anny83 » Tue Mar 30, 2010 5:37 am

hi everyone,

is this true???? I have heardd and read it the first time in this forum,I might have misunderstood, please can somebody clarify!!

I am german citizen and have a pakistani spouse, both entered the UK on 27th nov 2004, after my husbands first family member visa expired after a year we both applied for Residence permitcard for 5 years, which we got nov 2005 and it will expire nov 2010. Will our 5years permanent residence be compleeted??? Do we not have to apply for another visa or PR on EEAR form??? Can we apply for natrualisation intead???

Please help as i am confused. If yes when can we submit aplication?? In nov when we will be living here 6 yrs. may partner has also passed Esol entry level 3 will it compensate with life in UK test??

thanks in advance

Deutschland über alles !!!

Hey Wanderer, I totally agree with you on this one, though I've never been a great fan of yours from the way you respond to posts...too blunt or a bit hard.

However, I'm in heaven with you tonight. Ich liebe deutschland und meine frau ist deutsche

yes your husby can apply for naturization after 27th nov 2010 since you'v both would be here 6 years by then. you both obtained PR automatically on 27 nov 09, assuming you were here as a qualified person and hasn't been out of the uk for more than 6 months in a particular calendar year.

ensure you submit all the evidence confirming the fact that you have been exercising treaty rights for the past 6 years.

i hope this helps

Hi Anny83
I hope I’m not offending any one with my response.
My 1st comment is for Wanderer and El Shaddai, guys can you please behave regarding the football otherwise this could end with a huge argument we need to focus to brief people that are seeking help in this forums.
Anny,
Your partner and you are eligible to apply for the confirmation of the PR using EEA3+EEA4 under directive EU2004/38/EC you need to prove that you’ve been living with your partner for a continuous 5 years and the EU member exercising the treaty right.
Application for the citizenship is under British Law:
The EU member is eligible to apply if he or she can prove that been here for more then 6 years .
The non EU can only apply after 6 years if he/she is free of immigration control.
I advise the non EU member to wait till he/she obtain the confirmation of the PR then apply for the Citizenship, The fees are non refundable!!!!!!!!
Good luck

There is loads of information about this elsewhere here.

While you don't need to have an actual PR card to apply, you need to have qualified for one. If you qualify for PR, then one year later you would be eligible to apply directly.

Be aware that if you apply directly and there is a problem with your PR, you risk losing the fee.

Read this - EEA Family Permit to Naturalisation. Am I eligible?.

Was the so called "spouse visa" in 2006 an EEA Family Permit as unmarried partner of EEA national?
