ILR time count for Tier 2 Intra company transfer and Tier 1

ILR time count for Tier 2 Intra company transfer and Tier 1

Hi,

I went to UK on Tier 2 Intra Company transfer on 17th Jan 2010 and came back on 14th Feb 2010. Now I have got my Tier 1 valid from 29th March 2010 and planning to go to UK on 12th May.

If I land in UK on 12th May 2010 on Tier 1 then will my clock for ILR starts from 12th May or 17th Jan?

So will my time in UK in Jan-Feb on Tier 2 (ICT) count for ILR?

If yes then I am thinking of flying to UK on or before 12th May 2010 for not being absent from UK for a continuous strech of 90 days.

The policy suggest that 90 days outside country has to be in last 12 months which I believe is 5th year rather than 1st year of entering UK.

Seniors please clarify?

Tier 2 is Valid. Your countdown will start from that day when applying for ILR.

Thanks for the reply. Actually after April 6 changes Tier 2 Intra company transfer time will not be counted for ILR. But since my Tier 2 ICT was stamped earlier and I travelled to UK before 6th April so my countdown will start from 17th Jan 2010.

Does it mean that I need to travel on or before 12th May 2010 to avoid 90 days stretched absence from UK? Seniors please comment.

The time will not be counted towards ILR only if you have applied for Tier 2 (ICT) after 6th april. If you have applied for Tier 2 before 6-apr then you should be fine.

It is clearly mentioned in the change guidelines on the ukba site.
