Hi All,

My spouse-to-be is in a complicated immigration situation, and I need some advice on how I could go about obtaining her spouse visa in 2011.

My spouse-to-be has had her UK tourist visa rejected three times so far. The first two were in 2008 from our home country. In the first attempt, she was rejected due to insufficient funds, and after she provided sufficient funds through sponsorship in the second attempt, she was told that she did not have strong ties to the home country as she was not in full time education or working (she was between her bachelor’s degree and master’s degree at the time).

She eventually moved to Republic of Ireland to complete her masters in late 2008. In December 2009, she applied for a UK tourist visa from Ireland, giving a plethora of evidence, including letter from her university, payslips from her part-time job, proof of money in her account (in line with what a student might earn), etc. She even had UK bookings in youth hostels and travel by budget airlines and buses, which is what one would expect of a student. Unfortunately, the previous two rejections skewed the mind of the ECO – and she was rejected a third time, citing reasons such as “you are not serious about your studies in Irelandâ€

What you are trying to ask is what would the outcome of her application. Well the truth is no one can tell you in advance what would be the outcome of any future spousal visa application. The eco will decide according to the evidence presented to him. But yes, previous visa refusals will count against her. She has already made herself look like a person who is deperate to enter UK.

Thanks mrlookforward. My question wasn't around what the outcome of a future spousal visa application would be, but rather, what I could do to:
a) Strengthen my spouse's case, and
b) Avoid a silly rejection reason.

I am sure that my case isn't unique - and others couples would have faced similar circumstances. Are you aware of anyone who might have faced a situation like this and managed to get a spouse visa? I'd like to know how they would have gone about their application.
