Wife immigrating, Irish husband

Post by Trimax » Sat May 01, 2010 3:00 pm

Hello all! I am marrying my fiancee on the 7th of may in her country, Ukraine.

About me: I'm an Irish national, Living in Dublin at my own address currently unemployed and actively seeking work.
About her: Ukrainian national, Fluent english, recently graduated with specialist degree

soon we will begin the Visa process. I will return home to Ireland first and hope for her to be able to join me soon.

I have been doing allot of research on the law and am a little confused by the whole thing.

Can anyone shed a little light on the process on the following points:

1: Which Visa to apply for?

2: When we arrive together in Dublin airport (I will be flying with her when shes coming, as she has to transit through London, I'll meet her there) I have to walk through EU passport control and she goes through Non EU immigration control, Can I walk through non Eu with her to help answer any questions etc??

3: What to expect upon arrival at passport control?

4: I believe I must go to GNIB after that, what will she be hoping to get? A stamp 4? or an EUfam stamp 4? and whats the difference???

5: Will my unemployment be a factor? I recieve jobseekers, and of course am looking for a job actively, I hope to get one after I return from the wedding in Ukraine asap but if I an unable to do so in the near future will it make things more difficult??

Thanks for reading folks, any input here on any of my questions or anything you want to add that I think I should be aware of would be greatly appreciated. I want nothing more then to start my life with my soon to be wife and live and work normally here in Dublin with her.

1: Which Visa to apply for?

D visa join spouse. She has to apply for visa in the nearest embassy visa centre, I think it's Moscow. More info here:
http://www.inis.gov.ie/en/INIS/Pages/Ir ... nformation

2: When we arrive together in Dublin airport (I will be flying with her when shes coming, as she has to transit through London, I'll meet her there) I have to walk through EU passport control and she goes through Non EU immigration control, Can I walk through non Eu with her to help answer any questions etc??

You both walk through Non EU passport control and you can do all the talking. It should be easier if you are both present at the same 'desk'.

3: What to expect upon arrival at passport control?

present both passports, marriage cert, etc. answer any questions they may have. Pretty much have all the docs that you present for your wife's visa application handy. She would get a stamp in her passport for 1-3 months.

4: I believe I must go to GNIB after that, what will she be hoping to get? A stamp 4? or an EUfam stamp 4? and whats the difference???

Yes, you must go to GNIB with your wife. Take all the docs with you again. She should be given stamp 4 for a year.
EUfam stamp 4 is given to spouses of EU nationals other than irish following the processing of application (takes 6 months), so your wife wouldn't qualify for it.

5: Will my unemployment be a factor? I recieve jobseekers, and of course am looking for a job actively, I hope to get one after I return from the wedding in Ukraine asap but if I an unable to do so in the near future will it make things more difficult??

Your unemployment can make the visa application process more difficult or result in the negative decision as you have to prove that you can support your spouse in ireland.[/quote]

Thanks again for the advice. I have another few questions if you dont mind

As I said Im currently on jobseekers allowance, if I manage to get a job is there a certain amount of money they want to see me earning in order for a succesful visa application??

can I add additional sponsers to her visa application, for instance on of my family members and would it help?

Will having a job be enough or do they want to see me with a job and several thousand in the bank??

I was hoping to get back to education, would this help the visa application instead of the job, for instance University as mature student or an approved Fas/VTOS type course??

Will I need to buy her Health insurance before she applys for her visa ?

As for my address, She would need to be approved by stamp 4 before I can get her on the rent here, but they say they want evidence of joint address in GNIB in order to get stamp 4? any ideas?

Any input here greatly appreciated, Im just trying to figure out what type of financial status I would have to achieve in order to make this happen.

And thanks for the help folks.

sorry, i can't answer all of your questions.
in relation to the visa application, it will depend on your personal circumstances and the deciding visa officer. there was a poster on this forum, whose spouse was issued a visa even if he was unemployed at the time. but there are many more who were refused.

*Will I need to buy her Health insurance before she applys for her visa ?

No. you don't even need to buy a travel ticket until such time that the visa application is approved.

*As for my address, She would need to be approved by stamp 4 before I can get her on the rent here, but they say they want evidence of joint address in GNIB in order to get stamp 4? any ideas?

if she gets her visa and comes to ireland, you can open a joint bank account, change the bills to both of your names, that would be the proof of joint address. once she presents herself to GNIB together with you and all the docs, all going well, she would be issued with stamp 4, and then you can add her to your lease.

Hi, I'm married with an Irish National also. Just got married last year. I got my visa last week. Your wife should apply for a D-visa, which means long stay. My husband is currently unemployed and he is here with me in the Philippines. My mother in law also sponsored me. So my mom in law provided a bank statement, certificate of employment, payslips, P-60. Hubby provided his bank statement also. Make sure you meet many times, you have postal letter with each other or cards. I have included those even our wedding receipts, photos together and also photos with relatives and family. Your papers will speak for you at the immigration, make sure to submit a complete one. Now, everything is fine now with me and flying to Ireland on July :) I heard immigration in London airport is strict, you should try to fly via amsterdam. Anyway as long as your wife got her visa, make sure you bring the original documents you sent to Irish embassy (they will return it to you once got a visa) and you will show that to airport immigration. Goodluck to you and to your wife :) God bless...

Blueice2412 thanks so much for the information its very encouraging.

I have heard before that I can have people sponser her visa so I think I will try this, I have a huge family and they would be more then happy to help us.

I wish you great happiness with your husband here in Ireland, and please let me know how everything goes with GNIB etc.

Regards

Just on this, I was given a 5 year stamp 4, as the garda was saying something about what Irish spouses get being brought into line with what EU spouses get. But, as many of you here know, there are usually different rules for different people. May have been that myself and my now husband were known to the guard (as I had a green card in the past), but you never know.
