Help: Missed fee payment - Visa expired

Hi

I've had the unfortunate case of having my credit card payment not process, and only receive the returned HSMP extension application after my entrance clearance expired. This was completely unforeseen.

Timeline:
23 April - application sent
1 May - receive application confirmation letter with ref number, dated 26 April
10 May - entrance clearance expires
12 May - receive returned application invalid for credit card rejection, dated 30 April
13 May - re-send application with alternate payment + cover letter explanation
14 May - bank account shows payment taken

I've called and been advised my application will be considered but I will have no appeal right if refused as it was made out of time.

If I am refused, can I go through a solicitor and present my case for appeal right? In the meantime do I have to stop working and/or leave the country?

It's all so frustrating... any advice would be extremely appreciated.

AIUI, when there is no right to appeal you cannot do it - either DIY or through a solicitor.

The immigration law doesn't differentiate between DIY appeals and appeals through a solicitor.

IMHO ....

If refused do I have to leave the country? Can I make another application from start from within the UK?

If you meet the extension criteria then why are you worried about the appeal right.

If you meet the criteria you will get the visa.

I have seen many cases where visas are expired due to non payment but applicant gets extension (exactly as it is in your case)

If you know that your application will be refused then you should be worried.

Thank you - I'm sure I meet the criteria. I'm just clueless as to procedure when the visa expires due to non-payment... this helps.

I am very very sure that you will not get the refusal on the basis that your application sent after the expiry of your visa.

If you fulfill the qualification criteia you would be definately alright. But still it dependents upon the caseworker... but usually they do not create trouble for applicant in circumstances (non payment) as you are in..

not to worry, just relax..so many cases in the same situation got visas...
in my case my dependents application was sent back as invalid and by that time their visa expired 2 months ago and reapplied and got the visa with in 15 days.
Next time when apply for visa use postal orders..safe and secure..

Thanks for your responses - I received my successful extension a couple days ago. What a relief.

I had received an email from a case worker requesting an additional bank statement due to the delayed application. Once that was received I had my passport back in days.
