new requirements for spouse or partner applying for a visa

Post by leonleo » Thu Jun 10, 2010 1:12 pm

HO declared anyone wishing to come to the UK as a spouse will have to demonstrate basic English at A1 level (09 June 2010).

source: http://www.bia.homeoffice.gov.uk/siteco ... equirement

I'm still not sure what do they mean by A1 level or what is the equivalent score of IELTS (most common english proficiency test). It is related to Common European Framework of Reference for Languages.

Does anyone know anything about this?

leonleo, a careful read of the UKBA webpage will show that only applies to those wishing to come to the UK as the spouse etc of someone who is British or otherwise settled in the UK.

You have posted this in the Tier 2 area of this board, and those requirements do not apply to Tier 2 Dependants.

John,
So this rule is not applicable to Tier 2. Thanks for clarifying the issue. What about someone who has a indefinite leave to remain? Do they need to provide evidence for english proficiency?

Someone who already has ILR, they have nothing to do, unless they wish to apply for British Citizenship, in which case, if not already passed, they will need to pass the Life in the UK Citizenship test.

Or if someone wants to apply for ILR, then it is the Life in the UK Citizenship test that needs to be passed.

Thanks.

Recently my wife's visa application (as a tier 2 dependant) been refused. There was lack of required level of funds in my bank account as a sponsor.

We are planning to apply again in August. My questions are,
1. Do I need to do add any additional documents to apply for the second time?

2. I attached my tenancy agreement (original copy) during the last application and the HO kept the copy. Is it ok if I just add the photocopy this time?

3. In the VAF10 application form, (part 6) is asking about previous application date, country and reference number. In the refusal letter it has just a post reference number? Are they same thing?

Many thanks
