ILR (Work permit dependent visa + Spouse Visa)

I got ILR on 11-Jan-2010.(from work permit visa)
My wife got spouse visa ( settlement) from outside UK on 21-Jun-2010. She is due to come to UK in a week.
Since December 2003, she has stayed with me in UK for 23 months. She had workpermit dependent visa during her stay.
For rest of period, she was out of UK to continue her studies, vacation, my work related trips etc.

Following are her stay details in UK.
15-Dec-2003 to 21-Jan-2003 - 1 month 9 days - With work permit dependent visa
16-Oct-2004 to 15-Nov-2004 - 1 month - With work permit dependent visa
08-Jul-2005 to 31-Jul-2006 - 1 Year 20 days - With work permit dependent visa
21-Dec-2008 to 12-Sep-2009 - 8 months - With work permit dependent visa

I hold utility bills, rental agreement, bank statements in her name during her residence in UK.

Can she apply for ILR now or can we get spouse visa endorsed with KOL requirement.
Please advise.
