The date of issue on my current Tier 1 visa is 13 May 2009. I had applied just before the rules changed on 31st March 2009 and was thus able to get points for my Bachelors degree.
I am a bit confused regarding whether I will be able to take points for my Bachelors degree when I apply for an extension to the Tier 1 visa in 2012. This is because the language used on different forms is a bit varying:
1, http://webarchive.nationalarchives.gov. ... -of-policy
pg 5 states:
1 Points for a Bachelor degree and/or earnings under £20,000 will not be available for those who were previously granted leave under Tier 1 (General) on or after 31 March 2009.
Are they talking about the Date of Issue on my visa or are they talking about the Post Date when I made my application?
2, http://www.ukba.homeoffice.gov.uk/sitec ... l-form.pdf
pg 41 states:
* an applicant can only claim points for a Bachelor’s degree level qualification if they have, or have last been granted, leave to enter or remain as a Tier 1 (General) Migrant, Writer, Composer or Artist or a Self-Employed Lawyer Person; and that leave was granted before 31 March 2009.
This seems to be talking about the Date of Issue on my visa ("leave was granted")
3, http://www.ukba.homeoffice.gov.uk/sitec ... idance.pdf
pg 17 states:
Extension Applications- Applications for leave to remain where the applicant has, or last had, leave as a Highly Sskilled Migrant, as a Wwriter, Composer or Artist, Sself-employed Lawyer, or as a Ttier 1 (General) Migrant under the rules in place before 31 March 2009
An applicant can score the following 77. points for qualification:
• PhD* 50 points
• Master’s degree* 35 points
• Bachelor’s degree* 30 points
This seems to be clearly granting the 30 points for Bachelors based on Post Date of application.
Please help! Apologies if this has already been asked before.
