residential qualifying question - plz help

residential qualifying question - plz help

Hi,

I am a british citizen and my husband came from india on a spousal visa on the 31 May 2007. He recieved his ILR on April 23rd 2009.

My question is when can he apply for naturalisation (his total absences from th UK are 182 days ) but 140 days in last 12 months.

1. 30 Sep 2008 until 12 Nov 2008 (42 days)

2. 2nd Nov 2009 until 20 Jan 2010 (80 days)

3. 3rd March until 1st May 2010 (60 days)

everyting else is in order i.e good character, home, family.
:? Please can you advise, should I wait until Sep 2010 and hopefully UKBA will apply discretion? Thanks!

Last 12 month you cant leave more than 90 days out of uk,so if he leave more than that so maybe he can apply now bec 3 yrs finished in spouse visa requirement.

Hi, thanks for response. Sorry, I'm still a little confused. So I can go ahead and apply now for BC? wahhh help!!!! :?

Apply on/after the date when absences in the year (12 months) immediately preceding the application fall below 90 days.

Also make sure that he was present in the UK 3 years before the date of application e.g. - if application is made on 24-Sep-10 then the applicant must have been present in the UK on 24-Sep-07.

marcella, looking at the dates in given in the opening post of this topic, and subject to him not being out of the UK for more than 30 days between now and then, it looks like he can apply for Naturalisation on or shortly after 22.12.10.

John, yes i can see where your coming from. I think we will have to stick it out until then and hopefully it will just go through as a straight forward case in 2011 rather then rushing it in too soon now and failing.
