TIER 1 APPLICATION & APPEAL RIGHT...??

Post by HareKrishna » Fri Jul 23, 2010 4:41 pm

Dear ALL,

I am here seeking some help from respectful members.

I had applied for Tier-1 Visa once my PSW run out.
H.O refused to grant visa- Refusal Date-02/06/2010.
Appeal right was given. As Only Point I didn’t able
To get is from My Self-Employed. (Income-20 PTS. Not granted).
Rest I got all points for qualify.

As My Deadline for Appeal was 18-JUN-10.I thought it’s same like application
Submission to Home Office and Submit my appeal at 18 JUN 10. I had get letter from AIT about My Appeal is OUT OF TIME & First-Tribunal gave me up to 30 JUN 10 to Justify, if there’s any unknown circumstances for not to file appeal on time. I again attached Post Office 1st class delivery receipts & send back letter to Judge to consider my appeal as ON TIME APPEAL as I sent in last lodging date 18 JUN-10. I receive letter refusing my appeal is OUT OF TIME & doesn’t consider by Judge, as my circumstance is not exceptional. Judge explained me in his letter they must received my appeal Within 18 JUN Not at 18 JUN.
Than only I realised I did mistakes in lodging my appeal.

Now, I have lodged my case to HIGH COURT for Judicial Review, paying relevant Fees.

AM I DOING RIGHT…? I AM WORREID AS MY VISA EXPIRED ON APRIL-10, SO IT’S NOT BECOMING OVER-STAY CASE…
PLEASE SOMEONE GIVE ME SUGGESTION…WHAT SHOULD I DO NOW..?
I WANT TO MAKE FRESH APPLICATION IN OTHER TIER-CATEGORY…IF IT’S POSSIBLE…. NOW..?

THANK U IN ADVANCE…

SAN.
