ILR: when can I apply?

ILR: when can I apply?

Hi Guys

I got married in April 2008, and my husband applied for a spouse visa for me, I was granted this on 28 August 2008, I came to the UK on 20 September 2008 (as stamped by Immigration Officer at London Heathrow) my visa expires 28 November 2010. When is the earliest I can apply for ILR.

I also live with my in laws but the Gas and electricity Bills are in mine and husbands name, telephone bill only in my husbands name. I also have other documents such as bank statements, appointment letters, National Insurance letters and ESOL entry one and entry two certificates with a covering letter from the college.

I am wondering, because of the bills are in mine and husbands name but my in laws rent the house from the council will this be a problem?

Your advise is much appreciated, I have heard many good news about this website and its people.

You can apply for ILR no earlier than 28 days before the 2nd anniversary of you entering the UK (20Sep10).

For documentary evidence(s) required, see (Note 8 under Section 10 of) SET(M) form.

Earliest you can apply is 24 August which is 28 days before your 2 years is up
You will be OK with your documentation

I have read the application form, but has anyone applied for ILR Set (M) and what documents have you submitted.

Also I called Sheffield UKBA and I made an appointment for 13 September to apply in person. I want to ask do you advise me getting Immigration adviser/solicitor?

sushdmehta has already said, and if you have the SET(M) application form and guidance document - It is clearly written exactly what documents are needed, Out of a choice range.
People choose the documents from the list that they are able to produce!

If you have managed to arrange an appointment by yourself, Why then get a solicitor? Normally they would arrange an appointment for you and or fill out your application form and give you advice on the quality of your documents.

Yes the website is good, It's there to give answers. With respect to your situation. I would read the application form and guidance notes before you post questions. Because the questions are elementary.

Hi mochyn,

I had a similar query on when is the latest I can apply for my ILR and coincidently I had my qualifying period of 4 years completing on 20th Sep 2010. I have managed to get a personal appointment for 23rd Aug 2010 but was confused as it was exactly the 28th day when I qualify.

So I have posted my query on this forum and got a reply suggesting that I should be OK as the date falls within "No earlier than 28 days" period but I am confused again with your reply as you are suggesting 24 is the latest. Can you please suggest how you have calculated this date (24th) as 23rd looks to be the 28th day to 20th Sep.

Yes I have seen what is required on the form my real concern is that my husband seems to have more documents for him self then I have and I am worried about this. I only have the following:
Bank statements single and joint names
GP surgery appointments
National Inurance appointment letter
National Insurance letter with my number showing on
Gas and electricity bills joint names

I am just wondering whether they will penalise me on this, as the UKBA will find any excuse to refuse an application.

When I mentioned legal advise, I mean do you recommend I get Immigration advise from an immigration specialist before going to the appointment in Sheffield?

Also I would like advise if any one knows if Sheffield PEO check your documents before taking the payments? for example if the documents are incomplete do they still take the payments?

I have received my ILR which I got from Sheffield PEO, with out any problems. and to those who have never replied to my few questions, I certainly do no need any response from you as now this time next year I will be applying for British Citizenship.
