Succesful review of Tier 1 Visa(Pankina) What's next?

Post by tsleng » Sun Aug 29, 2010 11:16 am

Dear All,

I have just received my Tier 1 visa that I sent in for review based on the new policy guidance that came out from the Pankina case.

The details are as follows,

Sent documents (passport, ID card, bank statements) in on 9th Aug, arrive HO Sheffield 10th Aug
No confirmation letter received from HO
Received passport with 3 year Tier 1 Visa from HO on 26th Aug via self addressed special delivery envelope
I was in the UK lawfully when I did the review.

Very quick processing time in my opinion.

However. my question now is what happens come extension time?
As we all know now, the points requirement for extension of Tier 1 at the moment consists of differing rules depending on when the Tier 1 visa was issued.

The most stringent extension requirements are for those who got the Tier 1 after April 2010. Therefore, logically, I should be in this category if I want to extend in 3 years time.

However, as this is a review, my decision and visa length was as per when I first applied and got refused, March 2009. At that time (March 2009), initial applicants got 3 years leave to remain which is what I was given now.
However, those who applied after April 2010 will only get 2 years as initial and then 3 as extension.

So, does any enlightened souls here know on what basis my extension will be judged by? Based on the old requirements since I was given 3 years as initial applicant or based on me receiving the visa after april 2010? I hope it will be by the older requirement (more points for less earnings) because £35k/year to get my 95 points will be a bit of a pain :D

Thank you in advance!

You will qualify for extension as per rules in force at that time. Unfortunately, no one can predict for you 2/3 years in advance what the rules will be, then.

oh?

Did you include a self addressed enveloped?
All relevant documents sent to HO?

You should have got yours by now I would have thought.

Sending self addressed envelope does not speed up processing..

It does not speed up processing time itself but it does mean they can pop your stuff in once it's finish and send it straight back!

Better still special delivery as you can even track it if for some reason it gets lost.

It will also give them the good impression that you cared about the details.

Complicated? Mind sharing?

Mine was very very straight forward.

And I supplied all the documents.

Hi Blossom2009

My case is also bit complicated. It was refused in early this year.
I have sent a letter to home office in june 2010 and asked them for a reconsideration.I told them that I will file Judicial Review if they are not changing their decision.
In response I got a letter from home office in which they ask me to submitt my passport and pictures again.I sent my passport ans pic on sam day.

Its 4 weeks now but stll I have not received my passport. Its frustrating me now.Because some peoples are getting their passport back in 3/4 weeks(new applications).

I will update any progress immidiately. You also please
Thanks

You need to provide TWO sources of proof of income.
Therefore just providing salary slips is not enough.

YOu need the bank statements as well.

Post by blossom2009 » Wed Sep 22, 2010 7:47 am

Hi Tier1G2010,

Heard yesterday from UKBA that they require my passport size photographs so have sent those.
Did you send photographs with the review request?
