Hello mates,

I have been able to find the following as duidelines to ECO but it's from the HSMP days. Would anyone have the link or info to the following two points for Tier 1? Any help would be greatly appreciated. I want to understand the guidelines for ECO for the following two topics specifically.

“What time period should earnings cover?
The applicant can request that their earnings be considered for any consecutive period of up to twelve months within the fifteen months immediately prior to their application being received by WP (UK). Applicants do not need to claim for a full twelve-month period. If they only have earnings for a period of less than twelve months then this should still be considered. However, earnings for a period of less than twelve months should not be pro-rated up to a twelve-month equivalent.

“What if an applicant has not earned the amount claimed?
If an applicant has claimed points for an amount of earnings, but the evidence they have submitted shows that their total earnings are less than claimed, we will award the points that the actual earnings qualify for. For example, where an applicant has claimed three0 points for UK earnings and stated that they have earned £three0,500 during the period claimed, but from the evidence submitted we calculate their total income to be £19,700, we will award them 10 points in line with the relevant scoring band (band A).â€

The text you have quoted from is irrelevant as HSMP scheme doesn't exist anymore. If you keep comparing Tier 1 assessment with HSMP caseworker guidance, you'll remain confused.

From a Tier 1 perspective, here's the answer to your queries:
1. A single, consecutive 12 month period from the 15 months immediately prior to the date of the application. (4.1 of Appendix 1). You need to provide start and end dates of your earning periods (from the 12 out of 15 month window) for the caseworker to assess your earnings (4.5 of Appendix 1). If you do not provide accurate dates and submit corroborating evidence(s) of earnings for the (exact) stated period, your application may be refused.

2. If you have the above details wrong, then the second query becomes irrelevant. On the other hand, if you have the above in order, then in case the caseworker disagrees with the total amount of your earnings (e.g. - an applicant claiming reimbursements as earnings) he/she will award you points based on his/her calculation of your total earnings. Depending on how many points you need to qualify for Tier 1, this new assessment of your earnings and the associated points may or may not be enough.
