Advice for ILR eligibility..

Advice for ILR eligibility..

Hello Friends,
Hope you can help me out here.
I finish 5 years in UK on 27th November and hence would be applying for ILR.
Here are my details:

Entry in UK: 26th Nov 2005
On Work Permit (21-11-05 to 21-11-06)
Work Permit Extension (21-11-06 to 21-11-07)
Out of UK: 22 Days (26-01-07 to 16-02-07)
Work Permit Extension (21-11-07 to 21-11-08.)
Tier 1 General Visa - (03-06-08 to 03-06-11)
Out of UK: 22 Days (24-01-09 to 15-02-09)
Out of UK: 8 Days (05-12-09 to 13-12-09)

Here are my wife's details:

Entry in UK: 25th March 2006
On Dependent Visa.
Out of UK: 22 Days (26-01-07 to 16-02-07)
Tier 1 General Partner Visa - (03-06-08 to 03-06-11)
Out of UK: 104 Days (24-01-09 to 07-05-09)
Out of UK: 25 Days (24-11-09 to 19-12-09)

So it is WP + WP extension + WP extension (same company) + Tier 1 General Visa for me. Does anyone sees any issues in mine and my wife's ILR application? Do you think it would be a straightforward application?
Any help and pointers and advice would be highly appreciated.

Based on the info provided you should be fine. Your eligibility date is 28 days before 27th November. Your out of country days are below threshold and for wife should be fine as UKBA does not count for the absences for the dependents...for ILR.

Does that mean I become eligible around 31st October (28 days before 27th November) even if I take a PEO appointment Or for a premium service appointment you should have completed exact 5 years?

Also another query, one of my friend becomes eligible around March 2011 but his wife (on dependent Tier1 Visa) does not completes 2 years by March 2011. So can he and his wife apply for ILR or do they have to wait before she completes 2 years in UK (around June 2011)?

Hi,

Yes you can book an appointment on 31st October if that is 28 days in advance. For ILR you need to complete 4 years and 11 months.

For second question, your friend's wfe wont able to apply if she has not completed 2 years but i would wait for some other members to comment on this.
