Question regarding the maintenance for Tier 2 Dependent visa

Post by johnmsavio » Fri Nov 05, 2010 2:29 pm

Hi guys,

My wife is a Tier 2 Visa holder and as I am planning to join her I would like to apply for a dependent visa. On the application form, in the maintenance section there is an option for my wife's sponsor to sponsor me for a month. I contacted my wife and she in turn her sponsor, who said that he can provide the letter, but asked me why would he sponsor a dependent? He has promised to give a letter stating that he certifies my maintenance and accommodation for a month. After that one month what will happen? And also do I need any further documents from him? Also as I understand if I get this letter, I will not need to provide any bank statements. Pls comment on any of my questions and any help is greatly appreciated. Thanks a lot in advance.

Your questions are answered by the guidance, specifically look at the supporting evidence section.

Guide states:

'If the migrant's A-rated sponsor says they will maintain and accomodate the migrant and dependant until the end of the first month of the migrant's employment in the United Kingdom, you must send a letter from them which confirms this.'

So if the migrant's employment started say about a year ago (therefore first month of employment was a year ago), then the A-rated sponsor letter won't be consider for the dependant's application.

Is my understanding of the guide wrong? my interpretation of the guide would be unless both the main applicant and dependant make the applications at the same time OR the main applicant make the application first and the dependant make their later but before the start date of the employment (therefore first month of employment is in the future) then the letter would be considered for the dependant.

You cannot use an year old letter (sponsor undertaking) as evidence of maintenance funds for dependant EC application now.

Hey guys thanks for pointing out the points, however in the guidance it also states

If the main applicant under tier 2 is outside the United Kingdom or has been in the United Kingdom for less than 12 months, the family member must show that the main applicant or the dependant has at least £533 to support the dependant as well as the funds needed to support the main applicant. This is unless the sponsor of the migrant has agreed to maintain and accommodate the dependant until the end of the first month.
Can anyone comment on this?
