Applying for Tier 2 without Cos

Post by roadkill1979 » Thu Nov 18, 2010 12:44 pm

Will it make your stay legal ?
what will be the status till your application is with UKBA ?
Will you status be considered under same category?
Can you carry on work till the result ?

-My visa is expiring on 9th December (PSW)
-I am with this company for more then 2 years (initially p/t and now f/t for more then 1.5 years.

Novemebr pannel refused the Cos as they reached to the 32K salary Ranking this time. I was 2k short.

If my company change/raise my Job title and salary to 40k to be at A rank will it give more chance to obtain Cos ? (obviously)

(I don't know what will happen next but being with family and kids is not that easy to be relocated)

will update more soon.....!

yes you will be legal in UK. As long as your application is in process with UKBA.

your current status wll be extended until UKBA makes any decision about your visa application.

Yes you are allowed to work legaly untill then. You will see there are quite a few people in this forum who had to submit tier 2 application without adding a CoS. (not a good idea but UKBA have left no choice)

I am few steps ahead of u. i submited my tier 2 application without CoS. was rejected in 2 months. now i have appealed against there decision and meanwhile i am workin (Which is legal confirmed by immigration lawyers) and in parellel company has been workin on geting a CoS. no luck so far with CoS.

i am kind of surprised with 30K salary u havnt been issued a CoS. check following comment from a member who has allocated with a CoS in NOV panel even after being in E category. def less than ur salary
designuk wrote:Hi everyone,

I have good news, I received my cos today. It was being considered on urgent basis so I got the result before 12th panel (and yes the panel is still on 12th not 19th) So the news is not only good for me but also for other applicants for these reasons:

A) It is clear that UKBA is now considering all applications and not only extensions.
B) I was not on shortage list and still got the cos.
C) I am not highly paid and come into E section of their priority and still got through.
D) Urgent consideration cases have a very small number of cos available and still i managed to get one.

The reason I'm giving these reasons here is to tell you people that all is not lost. UKBA is not filtering applications only by salary etc, they are going through each genuine case. And the reason I have explained all this is to let you know that if I got it then rest of you will also get, so be strong and be patient.

This forum had been an immense help, and good luck to everybody. Do not worry, its going to work.

designuk was lucky for some reason:
NOW WHAT I THINK OF IS URGENT CONSIDERATION and EXCEPTIONAL CONSIDERATION
-whats the difference/
-how to apply for urgent consideration ?

Hi, has anyone else heard back from the Nov 12th panel?

Roadkill, I'm really sorry to hear the news. I'm in category E as well so I guess its going to be a negative for me. Good luck with your app and I hope it works out for you.

Urgent Consideration is when you send in an app to be considered by the Deputy (something) instead of the panel because you cannot wait to hear from the next panel meeting so presumably if your visa ends before Nov 8th.

As far as I know exceptional consideration is applying for an additional CoS when you have not been allocated one, either you already are using your allocation or you have not been allocated at all.

Just reread what I wrote, I meant Dec 8th. The UKBA website says you should hear back in 5 working days from when the panel meet so if you cannot wait 5 working days, you would be a candidate for urgent consideration.
