Hello There,

I was working in the UK untill Mid June and I came back to India on 1st Oct.
I took up a job in India as I was looking for work ever since I resigned from my work in June when I was in UK.
I got an offer and I started to work here in India and my annual pay is 12 lac/PA INDIAN RUPEES.

But now as I am aware that the rules for Tier 1 have changed and its closing down in April 2011, I am thinking of Applying for Tier 1 but I am uncertain to apply it from India as they allow not many applications.

I have a valid PSW visa for UK which expires mid-next year and wanted to check if I will be able to claim my Indian Income from Oct 2010 to Feb 2011 which will be approx. 5,50,000 Rs which is equivalent to about 38,000 pounds.

The query I have is, is it possible for me to go to UK in Feb 2011 (I have a PSW Visa) and apply for my Tier 1 from UK instead of applying it from India?

Will I be able to claim my Indian income which by the month of Feb 2011 would be Rs. 5,50,000/- Approx. (Oct 2010-Feb2011=Rs. 5,50,000)

Will I be able to claim the income earned in UK from March untill June which should be approx. 9,000 Pounds?

So is it possible to sum up INDIAN + UK Income in regards for my application of Tier 1?

Or I should just claim the earnings of Income generated from India? (I am present in India for the period I am claiming for Oct2010-Feb2011)

I did my MBA from UK.

Is it even possible for me to claim my experience points from UK Experience. I have worked in the UK for more than a year.

If there is anything else apart from this that you can suggest would be highly appreciated.

Will I be able to apply for the visa in the UK if I plan to fly there and apply the same and claim my Indian income as I am here in India since June. And will even be able to claim my experience points too? I have done my MBA from UK, I am a july 2009 pass out..

In my opinion I think you should be able to come to UK in Feb and apply for Tier 1. Since you'll be able to use the multiplier to ur earnings, u'll be able to apply for it using ur indian income only provided that you apply within 3 months from coming to UK as u need show the 12 months income within 15 months before the application.
Might be better to wait for a senior member's advice as well

1. You can use both Indian & UK income together. (Use multiplier to convert Indian income)

2. You can claim max 12 months income in the last 15 months. So choose 12 consecutive month in last 15 months. 12 months are max, if you are a good earner, less than 12 months pay might give you enough points to qualify.

4. I doubt, there will enough quota left in Feb 10. It's best to apply ASAP

@ Karani: But isn't it that if you have earned 16,000 Pounds from UK only then you can claim the same?

Say, if I show my income from 1 - Dec 2009 to 16 June 2010 from UK which will be about 11,000 Pounds + Income from India from Oct 2010 to Feb 2011 which will be about 5,50,000 Rupees.

I was living in the UK for the period I am claiming the income.
And I am in India since Oct 2010 and am planning to be here untill Feb 2011.

The only reason I want to go to UK is if its better to apply for Tier 1 from UK!

Would I be able to claim the same?

And I am thinking of going to UK in Feb 2011 and apply for my Tier 1 from UK.

As I have PSW Visa which expires in June 2011.

@ Silverline: Is there a limit in UK as well for application for Tier 1 Visas? I thought UK was open for as many applications they would receive for the same?

Please put some light on the same..


Can I expect some reply from Senior members as well..

Though a reply from Junior Members is highly appreciated too.

Tier 1 (General) policy guidance wrote:100. The applicant can claim points for previous earnings in any single, consecutive 12-month period during the 15 months immediately before the date of applying.

105. An applicant may claim for a period of earnings of less than 12 months if they have earned sufficient funds to claim the necessary points.
Reading the policy guidance carefully will help.

u need to show 16k UK earnings to claim 5 points from UK experience. Since u have said u already have PSW visa I assumed u can claim that 5 popints based on ur eduction in the UK.
Hope this helps.. but do go through the guidelines to make sure what u r doing is correct cos I'm no expert and I'm trying sort some issues myself :D
