APPLICATIONS STILL UNDECIDED WHEN THE INTERIM PERIOD OF GRANT ALLOCATION IS OVER


At the end of the interim period, applications that have not been concluded will be considered in accordance with the new rules that replace the interim limits. Consultation is ongoing on the form those new rules will take. Therefore, UKBA cannot guarantee that any application will qualify under the new rules, which could be significantly different than those rules in operation for the interim limits.

The question is

I'm presently on PSW and plan to submit by March 3rd 2010, will this rule apply to applicants inside UK or general?

Please help.........................

As per information available on date - From April 2011, the Tier 1 (General) route will close, essentially meaning that no new applicants will be issued leave to enter/remain in the UK under this route.

Keep an eye on UKBA website for more details or explanations on the matter in the coming months.

It means people who applied for Tier 1 (General) will be assessed under the new Tier 1 (General) rules (for exceptional talent).

As the replacement scheme is very likely to have much different and much stricter rules, it's highly unlikely that people who currently qualify for Tier 1 (General) will still do so after April (unless of course you believe that you have exceptional talent and that you will win the nobel prize sometime in the future . :lol: )

Tier 1 route for persons with exceptional talent is not a replacement of Tier 1 (General) but a new immigration category under Tier 1 that will be introduced next year. Just as Tier 1 (Investor) and Tier 1 (Entrepreneur) immigration categories are different from Tier 1 (General).

So suggesting that applications that have not been concluded at the end of the interim period will be considered in accordance with Tier 1 (exceptional talent) rules may not be true.
Applications that have not been concluded will be considered in accordance with the new rules that replace the interim limits.
New rules - Tier 1 (General) route closed - undecided applications refused, IMHO.

The devil lies in the details, which UKBA is yet to publish.
