Tier1 appeal success. Need help in indefinite

hi members

thanks for helping me ;got my passport today :)

Timelines of Apeal.

Determination letter received : 28 oct 10
Send Expedite letter: 26 Nov
Request for Passport and photo from HO: 29 nov
Send passport 3 Dec 10
Received 9 Dec. 10


The only concern for me is that of my indefinite stay. here my time lines.

inital hsmp granted: 26Feb 08 to 26 Feb 10.

Applied for extension: Refused and apeal.

Extended as tier1: 08 Dec 10 to 08 Dec 13.

now my query and concern in that what happend to my 10months period. i.e from 26Feb 10 ---- 08 Dec 10. ???


Whether it will be counted towards my indefinite or not????? i.e Can I apply for indefinte from 26 Feb 13 or will i be applying from 08 Dec 13????

Also Do I need to show all claimed points again for indefinite or not??? please guide me

members please reply.

no one knows what will rules be in 3 years time so its way too early to say what points will you need.

Hi,

I had a similar problem as your,,,,Tier 2 extension refused but reverted following a successful appeal.

As long as you appealed on time (ie-before your current leave expires or prior to the allowed days of appeal....the last date for appeal must have been mentioned somewhere in your refusal letter). If you appealed on or before that date, then you should be fine, It does not matter how long the appeal took from hearing to stamping.

In my case, was refused 06/09, appealed in time, hearing 08/09, decision late 08/09. Stamped 12/09.

Hi Gaboon,

I've won my hsmp extension appeal on 17th december, judge announced the decision there and then, received the determination aswell, I just want to know the address where you sent letter to expedite the case and what did you mention in the letter? cz in your case it really helped dint it?.

My appeal allowed on 12/11/2010 but havnt received letter???

Hi gaboon_viper,
Congratulations...Good 2 hear from u that finally u got Visa...I think yr whole appeal time(10 months) should be counted. So I guess u can apply ILR in Feb 2013.
As I have written on top(topics) I had my Tier -1 (General) refused & Appeal hearing on 12th of November 2010 & Judge allowed/ sucess....but havent received any letter from court yet. I have called 2/3 times but they reply that my case is reserved, neither allowed nor disallowed...I am in a big confussion....Can u pls tell me yr whole appeal process time schedule pls?
Waiting 4 yr kind & Quick reply pls..
