Lost Passport with ILR

While in India, my daughter's passport is lost. My daughter is 4 years old. We all have ILR stamped and my daughter was born in UK.
We have our return ticket booked next week. Can someone please advise what to do.

1. Can we apply for british passport being in India.
2. Is there any way to get any sort of travel documents issued ?

My daughter need to attend school, so any help will be deeply appreciated.

Was your daughter born before or after you were granted ILR?

Alternatively, apply for a non-British passport and apply for a returning resident entry clearance.

Many Thanks for your response. What I understand is that I have two options.
1. Applying for British passport in India - however processing time is upto 12 weeks. I need to check what is real waiting time.

2. Getting Indian passport and applying for returning resident. That might take around 1-2 months.

Any Idea if they can issue Emergency Document . I will try to to apply for Urgent Travel document once I go to embassy on monday.

on what basis do you think she will get british passport.

Thanks Vinny, You were so right.

Originally talking to British High Commission , councilor said that I need to reapply for ILR again but on further pursuing they admitted that returning resident visa was applicable in this scenario.

We have applied for Indian passport but they are taking ages to process it. System is so corrupt here and I will need to pay bribe to get that processed timely.

We also talked to British embassy; they said that it will take up to 3 months. Can anybody suggest what the actual processing time is?

Finally, after a lot of struggle, we managed to get Indian passport. We are in a bit of doubt which path to choose.

1. We contacted the VFS guys in Delhi and they said that we should apply for returning resident visa. However one of the guys in High commission Delhi said that we need to apply for a new Visa and pay all the fees again.

2. Technically we can also apply for ECB17.2 Replacing a visa (or leave) but as per the website we will need to pay whole fees again i.e. 900 pounds (65000INR)

3. One of my known was in a similar situation. She lost her passport with ILR. She got a new passport and went to Airport to fly back to London. Airport check-in did not check the visa status and let her go. Later Visa officer found that there was no stamp and then she was taken to their supervisor. Supervisor contacted high commission to check if she had a genuine visa in the past and then let her go with a letter. Immigration guys called Heathrow guys to update the situation to let them know that someone was coming.

She came back in London and applied for transferring a visa (not Replacing a Visa) and paid a fees of 165£. She was issued a visa in couple of months.

Do you reckon going that path will be risky? We have all the proofs like child birth certificate, old passport copy, ILR approval letter etc, return tickets, consumed boarding pass and Child is endorsed in mother passport too. In case we are not lucky and they don’t let us go then we may loose on ticket.

4. As soon as my daughter is in UK we will apply for British passport. Is it legal to register the child as British citizen and at the same time applying for any category of UK visa?

Could you please advice which path will be appropriate here?

if you think technically you can qualify for returning visa then go for it. be ready for appeal if required. dont even think about doing no 3. that is crazy....

Finally Option 3 worked and my family joined me here in the UK couple of days ago.

Its already mentioned in the post. One option can be to call Airlines of destination and seek their approval.Make sure to keep all documents along like ILR approval, passport copy etc...

This is just to let you know that i have managed to get the Indian passport for my son in 2 days by meeting the Passport officer and requesting him to process the application quicker(although it was not very easy to do that).

I also got the 'Returning resident' visa for my son in a week. I met our local MP in the UK who provided me with a letter addressed to the British High commissioner requesting him to process my application quickly. I think that helped us obtain the visa in a week's time which otherwise could have taken longer as it is a settlement visa.

I just liked to share my outcome so that it might be useful for others in similar situation.

Thank you all who helped me with your posts/advices particularly Vinny.
