EEA Family Permit

Hello all, I'm new here and have a few questions on getting the EEA Family permit. I am Canadian and my wife is a French citizen living in the UK which i know makes up able to get the family permit.

My question:
1> I have a criminal record from about 7 or 8 years ago i know i have to get a police clearence (going to the OPPs to do so) its mostly lil kids stuff from when i just turned 18 til about 21 it is mostly theif unders and things like that.. My question is this can they hold that against me or refuse my application for these things?

2> I am currently laid off but have the letter from my job stating that I am in good terms with the company and have a savings atm of about $3000 Canadian and was wondering if that was adaquit amount of saving for the permit?

Let's just clarify this. You have chosen the words that you used and have included the word "mostly"!

So for the avoidance of doubt, please give details of the most serious conviction showing on your record.

Well about 7 years ago i was charged with a uttering threats to a security gaurd from a store i was stupid and mumbled something will stealing something and a few years before that i did a Break and enter on a store

I don't think that such convictions would cause the rejection of an application for an EEA Family Permit, or the Residence Card which will follow.

So I think .... proceed to apply!

Also i was wondering about her Birth certificate and if i need to include it in the supporting document since it says

They should include all the documents they can to show that they qualify for an EEA family permit.

As a guide they should include:

a copy of your EEA national passport (endorsed by your embassy in the country of application); and
proof of their relationship to you (for example, their birth certificates or marriage certificate); and
a letter from you declaring that you are travelling with them or that they are joining you in the UK.

You need a proof of relationship. The birth certificate obviously wouldn't do that.

Hmmmmm maybe i can call the translator and get it cancelled and my money back then LOL

Ok I have the long form Marriage Certificate and photos and emails and wedding pictures and vacation pictures. Also i am currently laid off from my job have been for 2 months now well since before Christmas. I will be including my Record of employment from there and my T4 and i was wondering what proof for the taxes would i submit or is the T4 significant?

Your financial/job situation is probably pretty irrelevant. What is important, however, is that your wife is exercising her treaty rights in the UK since she lives here already. So what is she doing here?

She is the site manager for a cleaning company and has been for 7 years now. Also i have a letter from her area manager saying I am guaranteed a job when I get my NIN number about $4000 CND saved approx. Â£2549 so after i buy my ticket around Â£2000 is that enough since i have the letter??

There are no fixed amounts. If she is a worker she is a "qualified" person but she would still need to have sufficient income to provide for the two of you. With a full time job that should be ok. In that case your financial situation is simply irrelevant.

Â¬ Pictures, emails, Cells phone records
Â¬ Copy of her bio-data pages from her passport
Â¬ My T4 and notice of assessment for 2010 taxes
Â¬ Letter from my former employment about my lay off
Â¬ Also photo passport style

Requirements. It is well known and also acknowleged by the UK that the application form asks for much more than is legally required. It is your decision what you want to include.

If you read this link carefully and reread what I have said before you would see that some of your documents are actually quite redundant.

RKnight1983, as it is clear that your "wife is a French citizen living in the UK" and that she is employed, that is, she is exercising Treaty Rights in the UK as a "worker", there is no reason for the EEA Family Permit to be denied.

1 Last question would you recommend me getting her passport a Certified Copy or just a normal photo copy will do??

Where is your wife now? If in the UK she should go to any Solicitor and get a certified copy of the name/pic page from her passport.

I believe only original documents are required. I would suggest she send you her passport or French ID or residence card, either one will do for your wife identification. And note, you should send your wife bank statements and pay slips with your app as that's what you need to show that you will not claim benefit.

Well we got the certified copy of the passport, and the translation of her birth certified with translator bank statements no because of a wrong address on her bank which it took them 3 weeks to send them to the wrong address which is shit but i think we should have enough as is and we're applying on the 29th so ill keep you all informed

Well we did the application on Tuesday and its now Monday and ITS BEEN APPROVED THATS 3 Working DAYS AND ITS DONE ^_^
