Transitional arrangement beyond 6-Apr-2011 Tier 1 (General)

Transitional arrangement beyond 6-Apr-2011 Tier 1 (General)

Hi,

The following UKBA link mentions that there will be transitional arrangements beyond 6 Apr 2011 for Tier1 General in UK applications. Any one have any idea what these arrangements will be? Will these allow existing PSW visa holders or certain other visa holders to apply for Tire 1 General from within UK beyond 6 April 2011?

The link makes no reference to "existing Tier 1 (General) migrants". And, IMHO, the statement you've quoted is not meant for existing Tier 1 (General) migrants. Reading this post will be useful.

The government has not yet announced any changes (or intentions thereof) to immigration rules regarding leave to remain (extension) for existing migrants. Any uncertainty on the matter is, as yet, just a result of individual imagination(s). This said, you may find reading this topic helpful / reassuring.

Unless the government announces details of the transitional arrangements, no one can tell you what these will be. If people claim they can they will be lying, which is anyway not going to help you.

As per information available as on date, Tier 1 (General) will close on 06-Apr-2011 and from that day onwards, no new aspirant will be able to apply for Tier 1 (general) scheme (cannot apply for a scheme that no longer exists).

Please note that one cannot be considered an "applicant" unless the individual has already submitted an application for leave to enter / remain.
And the statement regarding transitional arrangements refers to "some applicants in the UK" and not "some/all residents in the UK wanting to apply for Tier 1 (General)". That is how, at least I, interpret the statement.

In response to your PM,
1. Tier 1 (General) for overseas applicants will permanently close as of 00:01 23-Dec. The changes to immigration rules for this closure to take effect have been laid in the parliament (on 21-Dec).
2. As per information published by govt. as on date, Tier 1 (General) will close for UK applicants on 06-April-11. Understandably, it is expected that the government will lay details of the changes in the parliament in due course so that the changes can take effect as announced.
3. Whilst one may believe that UKBA "promised" Tier 1 (PSW) migrants guaranteed entry to Tier 1 (General) immigration category, there is no provision in the immigration rules or the policy guidance(s) to suggest or substantiate any such claim / perception.

PSW Transitional Arrangements

I learned from a Public Request for Information website that transitional rules for PSW to other schemes are still underway as of 26 Jan 2011 as disclosed by the home office. Basically as of now it seems that only tier 2 is the option which may change if there are any changes to allow PSW to switch to another category of visa.
Its only in March that they would probably announce these.
