More on review/appeal

Post by hsmphopeful » Wed Mar 17, 2004 9:34 am

Greetings

I have been informed that when requesting a review of decision under s.25.1 of the programme one CANNOT provide further evidence/docs - the appeal may only challenge the interpretation/evaluation of evidence already supplied. If one needs to submit further evidence in order to appeal a fresh application must be made and all evidence must be resubmitted and of course the fee paid.

Hope this helps someone! :-)

Thanks for that. It will certainly help the reject cases.

What have you decided to do? Resubmit or request for a review?

Does raise a question for the Moderators - What in your view does this mean? If a person applies again, wont they refer to the original application and look at reasons for refusal???? And if they did, what is the point in the applicant preparing the whole document again? If it is the Fees, they could just charge additional fee for review.

I sent a request for review and if it fails I will apply again later this year with additional evidence and help of a solicitor.

hsmphopeful,

Good luck whatever option you choose to take.

If I remember correctly, we addressed the 'pros and cons' of appealing and resubmitting on the 'old' forum..

perharps if you refer to it (old forum posting)- it may help you in making a good decision,

Good Luck

On what basis did they refuse your HSMP application?

Not enough points - because instead of 50 or 35 they counted 25.
