Tier 1 Visa Extension and Switching category

Hi,

I am currently in UK on Tier 1 (Partner) and our visa renewal is due in October 2011. My wife is the main applicant but she is not working regularly because of the economic situation in UK and job scarcity. So it seems that it will be a challenge for her to score adequate points on income here which are needed for renewal.

Here my query is

Can I switch from Partner to Main applicant while we are in the UK. (I am able to score the relevant points)

I am looking forward for the advise and process to help me get a renewal.

The link which you referred says that following are allowed to switch

If you are in the UK and you want to switch into Tier 1 (General), you must currently have permission to stay here in one of the following immigration categories

any other Tier 1 category

Yes, you are not in the UK on Tier 1, you are in the UK as a dependent of a Tier 1 applicant.

Can you help me get the right perspective for the following

Entry clearance is taken when we get in principle approval for the Tier 1 visa. (i.e. when we get the Home office letter).

Can I apply for Tier 1 general while in the UK (but not into switching category)

After receiving the letter from home office if I go back to my home country and apply for Entry clearance.

Mulderpf has already given you the answer to your question and set it out clearly.

there is no such thing as a 'switching category' switching just refers to applying for leave to remain in country from one category to another. What you have suggested is not possible. You can't get 'principle approval for the visa' in country and then return abroad to get entry clearance.

You can't apply in country as a Tier 1 General main applicant if you are here as a Tier 1 dependent. You can no longer apply abroad as tier 1 general is now closed for new applications from abroad.

Your only real options are for your wife to try to get a higher paid job or for you to explore whether you meet the requirements of Tier 2 and apply for that from abroad.
