Will short past overstay affect my tier 1 application ?

Post by supersky » Sat Jan 15, 2011 1:47 am

Hi

Back in 2006, I submitted the student visa application 2 month after the expiry date of my previous student visa (waiting for some documents). Although there was a 2 month overstay period, my student visa was still granted in 2006. Afterwards, I got a PSW and then a 5 year work permit in 2008. I am currently still work permit holder.

If I want to switch to tier 1 general , will this history of short overstay affect my initial applicaton and the subsequent extension?

Since there's a part in the tier 1 application form about immigration history,Do I need to disclose this overstay in the application form and how to fill this part - D16 and D17?
D16 Has the applicant ever stayed in the United Kingdom beyond the end of his/her period of leave?

Yes- go to question D17

D17 Give the reason(s) why the applicant has stayed beyond the end of his/her period of leave and the dates of the overstay

Many thanks

SS

You should be OK. But explain everything clearly in your cover letter and NEVER hide any factual information.
