Does Paterntal leave count as maternity leave?

Post by Tsar » Sat Jan 15, 2011 8:35 pm

Hi there,
I need to apply for my Tier 1 extension soon. I had been on maternity leave for 12 months after which I resumed work for a month and then took a Paternal leave for yet another month. Since then I have been working full time now for past 6 months. My query is in order to calculate my previous earnings, can I count my these past 6 months earnings + 1 month earning before my Paternal leave + and then remaining 5 months before my Maternity leave.
On the Policy guidance, I have read that in normal circumstances you need to show your income for CONSECUTIVE 12 months out of 15 months. However it doesnt say CONSECUTIVE for the maternity related absence.
So can I consider ANY 12 months from my last 15 months periods (excluding my Maternity and Paternal leave) or does it have to be CONSECUTIVE again. Is Paternal leave considered as Maternity realted absence as I took it almost after my maternity leave. Obviously my Paternal leave was unpaid and hence I am short of 1 month income making it difficult to meet the 75 points criteria.
Would appreciate replies as soon as possible.

Many Thanks.

I don't understand. Maternity leave is for mothers. Paternity leave is for fathers. Not sure what you mean by paternal leave?

Its Paternal leave and not Paternity Leave. Paternal leave can be taken anytime after your Maternity leave by mothers or fathers (now) till your child is 5yrs. And I being a mother had taken Paternal leave (not paternity) after using my full Maternity leave (12 months)
My question thus relates to my Paternal leave.

I think you meant parental leave. And no, it doesn't count as maternity leave.
Do not send me PM's with specific questions - post question in the open forum so others can also benefit from the answers.

To the my of best knowledge, statutory leaves doesn't break the consecutive period, even if you haven't received any statutory pay.

Thanks Silverline. You are correct. My Statutory leave is consecutive but after finishing that I took my Parental leave which apparently is not considered as maternity absence. Hence the query.
Thanks everyone. I have now got answers for all my queries.
