I just wanted to check how other people on this site got their NI number with their EU Family Permit, prior to applying for EEA2 residence card.
The two people we spoke to when trying to make a EOI appointment at the Job Centre did not understand what a Family Permit is. They kept asking if we were sure we didn't need a spousal visa and didn't understand my husband's right to work was based on EU law and our marriage (I am Irish exercising my treaty rights as a student).
They didn't give him a appointment date, instead they sent the NI number form through the post and on the letter it says "You should only complete this application form if you have a current UK Visa, that was issued outside the UK and that gives you the right to work here . "
I feel that in this case he should not fill out this form as the Family Permit is not a visa that gives him the right to work, is is a form of entry clearance as defined by UK Border Agency. As far as I understand he doesn't get a visa as it is his marriage to me that gives him the right to work here with the EEA2 card confirming this right.
Should he fill in the form and hope for the best or call again and insist on an EOI interview? Perhaps we are worrying over nothing.
