How 5 years would be calculated for me to apply for ILR?

How 5 years would be calculated for me to apply for ILR?

Hi there,

I got first entry clearance (HSMP) on 22nd April 2008 for a period of 2 years. I landed in this country on 10th of May 2008. Now i have got extension (Tier 1 General) upto 9th April 2013.

From 10th May 2008 to 9th April 2013, the total period would be 4 years & 11 months.

Would i be able to apply for ILR?

If no then what i have to do?

earliest you can apply is 28 days before 10 May 2013, which is 12th April 2013. You appear to be short by few days, As per current rules you need to apply for Further Leave to Remain (i.e. extend your visa) before you could apply for ILR.

That is still 2 and a half years in future and no one knows what the rules will be,. They may very well increase the ILR duration from 5 years.

Thanks for your reply. I agree that in future what will happen, no one know but keeping the current rules, we can at least discuss and make sure things are in control.

Here comes two questions;

1- You said i am short few days and i have to apply for extension. What is the procedure for that extension? I mean the form etc or category so that i shoul be ready for that.

2- As for i was reading guidance

If you look at following lines, you will see they mentioned word "Several Weeks"

"If you entered the UK with a visa several weeks or
more after the date from which it was valid for use, you
may need to apply for an extension of stay to complete
the relevant qualifying period."

They didn't mention days and also here we are not sure what exactly several weeks is meant?

You thoughts please?

forget about it at least for 2 years then start thinking, you suppose to have lots of other things to do for life.

You are right but there is one very important point of understanding rules and also you would be surprised to know;

"I got my first entry upto 22nd April 2010, but my extension is not 22nd april 2013. It is 9th April 2013."

So home office made some mistake while doing this;

Should i call them and resend my passport to get the stamp of correct date?

because you might have applied for extension a little early.

the same as when you applied for extension last time.
