can i go back to student visa From COA application

Post by sumon010107 » Fri Jan 28, 2011 12:51 am

Hi every one
I was studying my Post graduate diploma and my visa was expiring another 2 weeks when I applyed for the COA in 2009. Still it is under process and I am waiting for the COA since May 2009, but in the mean time I've finish my proposed degree. I need to study more. So I want to know can I apply for my student visa to be extended?
Please can someone tell me about this........?

Did you apply for extension of your visa in 2009, before it expired? Do you currently hold a valid leave to enter / remain?

Confusing, to me atleast.

So when did your (last) visa expire .. date? And did you submit an application for leave to remain before that date?

I may have misunderstood what you are saying but if you are saying that you applied for the CofA before your student visa expired but you did not apply to extend your student visa or make an application in another immigration category, then you are now an overstayer.

A CofA is not an application for leave to remain it is just an application for permission to marry

As per Sushdmenhta's question, when did your last visa expire (if it has expired)?

In that case you are an overstayer since 31-May-10.

You may apply but, in all probability, it will be refused for the reason stated above.

In addition see Immigration Rule Paragraph 245ZX (l)

(l) The applicant must not be applying for leave to remain for the purpose of studies which would commence more than one month after the applicant's current entry clearance or leave to remain expires.
