My Dependent visa rejected ,but not cleared with decision

You have applied for an entry clearance to the United Kingdom as lhe Partner of a T2 ICT
Migrant. I have considered your application under paragraph 319C and 320 ofthe United
Kingdom lmmigration Rules. You can read these Rules at:

Any documents you have supplied in support of your application iave been considered and
recorded. It has not been necessary to interview you in older to teach a decision on your
application.

The Decision

You have applied as the dependant of a T2 Migrant You have applied with your son and are
travelling with your son. You wish to make frequent visits lo your spouse in lhe UK and all
expenseis with be borne by TATA, A rated sponsor' This is coroborated by the letter from TATA'
certifying your maintenance.

I have atso taken into account lhe conlents of the letter from your spouse where she clearly
states: 'my son would be with me till my visa period in the UK under a day care centre, but my
husband will be visiting ....,. as he is placed in Mphasis. ..".

I am not satisfied that entry is being sought for a purpose covered by the lmmigration Rules. 320

I have therefore refused your application because I am not satisfied, on the balance of
probabilities, that you meei all ofthe requircments ofthe above paragraph(s) of the lmmigration
Rules.

I think you need to consult a good immigration lawyer because refusal under paragraph 320 is very serious.

Only some parts of 320 (e.g. 320(7B)) are serious. Prasad - your transposition has some holes in it and it's missing some of the important bits - e.g. "as he is placed in Mphasis" - what does that mean?

Also, his refusal was on 320 (what)? It makes a material difference here.

It sounds however, so far, that you said that he would simply be visiting you rather than living with you. A dependent visa is for two peopl who want to live together, otherwise he should have applied for a visitor's visa.

My husband is working in mphasis comapny and we submited letter from employer that he got approval of 10 days leave for his visit uk

I am sorry, but I am afraid you asked for rejection. The visa officer had no other choice except to refuse your application.

PBS dependent visa is meant to be for the purpose of living together. If you say that you have 10 days of leave from your company and you'll be visiting your partner for short durations only than actually you are asking for a multiple entry family visit visa and there is no way you are going to get a dependent visa after this statement.

You should apply for family visit visa now with full explaination.
