Maintainance Fund and Overdraft!! Big Problem

I notice that there are some confusion regarding the account going overdrawn and wether or not it will affect the Tier 1 application.

please see below, response from the UKBA. It obviouly affect the Tier 1 G application, as far as claiming points for maintainance is concerned.

Thank you for your email.

We cannot comment on specific cases or advise as to whether a specific application will satisfy the criteria. I can confirm however that all bank documents submitted with an application are considered when assessing maintenance. Where evidence from two or more accounts is submitted we will consider the funds available to the applicant to be the aggregate balance of these accounts.

For example if one account is £3000 in credit and the second account is £1000 overdrawn, we would consider the applicant to have £2000 of funds available to them.

I hope this helps to clarify our policy in this area.

I was going through the Tier 1 General policy guidance and I have a query regarding the Maintainance Fund and it would be great if you could please clarify that for me.

My query is as below:

If an applicant has two bank accounts (in the first account the salary gets
credited) and in the second bank account required funds for the maintainance has been kept for more than 90 days.



Now, the scenario is that the first bank account where the applicant gets his salary credited every month has an agreed Overdraft facility and the applicant keeps using the overdraft every month. As a result of it, the salary account of the applicant always shows negative outstanding balance of £3000, as a result of using the

overdraft.

Now, the applicant has a seperate bank account where he has maintained £1400 from last 90 days to show the maintainance fund (for self and spouse).


I just wanted to confirm if the negative outstanding balance in the salary account which is due to overdraft, will be a problem as far as maintainance fund is concerned.

Since the applicant has to send both the bank accounts (first one to prove monthly salary credits, but has negative outstanding balance) and the second bank statement has to be submitted for showing the maintainance fund.

Please advise, if the negative outstanding balance in the salary account will be of any problem as far as maintainance fund is concerned, as the first bank acount will be submitted just to prove the salary credits.

Will the case worker look at the 2nd bank account ONLY as far as the maintainance fund is concerned or will he combine both the bank statements and then calculate the available funds for maintainance.

Makes perfect sense I'd say.

If you have to run an overdraft to fund another account to show the maintenance fund requirement then you do not have the required funds since you're effectively borrowing the maintenance funds from the bank.

i used to get salary in my abbey account til october 2010......since november 2010 i am getting salary in nation wide account.....i am attaching only nation wide statemnt for last 3 months as my maintainence funds...the closing balance for abbey bank account in october was last in negative over drawn....

Wil the case worker wont bother about the abbey bank balance back in october as there are no latest statements attached and will he only consider my nationwide statement for last three statements as i am only attaching these for last 3 months maintanence
