ILR for work-permit holder getting CTC

Post by moni69 » Tue Mar 14, 2006 2:50 pm

Hi,
I had arrived in the UK from India, in April-03, on the advice of one of my colleague, I applied for Tax credit.(CTC)
Although my visa was stamped with "no recourse to public funds", I got through the tax credit application, and till date I am getting tax-credit every month.

Now, one of my friends have told me that I MIGHT have problems in getting ILR, as I was on benefit (CTC).

What is the best way to go forward in this situtation, as I have one year exactly to apply for ILR.

Somebody Please advise

It's two years to ILR for you now...5yrs from your WP...

Also, you should have known that you shouldn't be getting Tax Credits... not that difficult to understand from the visa!

Can you get the Inland Revenue to stop the credits... and pay back what you have been getting?... that should help.

The tax credit was not regarded as a "public benefit" untill 2005, and I had applied in the year 2003,

Secondly, its one year (April-07) for my ILR, as i had arrived in UK in april 2003, so it will be 4 years in 2007.

The ILR rule has been changed to 5 yrs now... so if you started your WP in 2003, you will be eligible for ILR in 2008...

Rules have changed to 5 years with effect from 3rd April 2006. Read the following topic for more details.

So why have you not discontinued them since then?...asin you could have told the Inland Revenue to stop the credits after 2005?...

Given that exactly this same subject came up Sunday/yesterday I am disappointed to see yet another topic.

Can we continue this discussion in this topic please.

Moni69, have a good read through that topic. Much more on the subject there than here.

I am going to lock this. Moderators are determined to cut out duplicate topics.
