ILR or Tier 1 gen extension

Hi All,

I arrived in UK on 6th Dec in 2006 (First Entry) just stayed in UK for a week to attend few interviews. Then I came back to UK in Mar 18th 2007. There is a gap of 97 days where I am absent in UK. For rest of the years I do not have such major gap.

My visa expires in Nov 2011 , am I eligible for ILR?

On what visa did you enter in 2006.

IMO you do not qualify in Nov 2011 due to 97 day gap without a valid reason.

I entered UK with HSMP visa. Currently on tier1 general

A single continuous absence of more than 90 days is not allowed, as per the IDI).

As this absence was "personal" rather than work-related or employer authorised, it is unlikely that a caseworker will apply discretion (if allowed to in such case) in your favour.

Thanks a lot, I will prep my self for tier 1 extension. Ideally I should be able to apply for ILR after 2012 March.
