Points for UK experience - Query

Hi All
My friend is in a strange situation. He needs 30k GBP for Tier-1 extension. He has earned that amount in 12 month period but he was in Switzerland on business visit (through the company for which he works) and during that time also he was getting salary in UK. But he is physically NOT PRESENT in UK when earning around 20k. So the result is he is physically present in UK while earning remaining 10k only. Yesterday there was a 'statement of changes' made by UKBA.

My query is "can't he claim 5 points of UK Experience?"

Table2: If 16000 GBP or more of previous earnings were earned in the UK.

Table3: If 25000 GBP or more of previous earnings were earned in the UK.
