Applicant on Tier 4 student - Spouse on ILR - what next?

Dear All,

At the time of my marriage with my wife we both were on student visas, therefore we obtained a COA from HO in order to register our civil marriage in 2008.

Now I have recently received my ILR in 2011. My wife is still on student visa. She has been in the UK since 2005.

The question is:

- Can she apply for settlement directly on an FLR(M) form
- Or she has to apply for a spouse visa first for 2 years and then apply for settlement on FLR(M) form?

What form must you use for spouse visa, if it is FLR(M) than is she going to have to pay the £900 fee twice, once for spouse visa of 2 years and than a settlement visa again?

I am a bit confused, any guidance will be much appreciated.
