Is Tier 1 PSW holder allowed to receive SSP?

Post by dochas » Sat Mar 26, 2011 1:25 am

Hi everyone. I'm currently on Tier 1 PSW visa and working full time. I'm off sick from work and the company where I work will pay me SSP (Statutory Sick Pay) and claim it. If I receive it will I break "No recourse to Public Funds" rule? Is SSP income-related employment and support allowance or contribution-related employment and support allowance? I'm very worried if I'm going to break the law. Please please advise me.

Can anyone advise me please if receiving SSP is breaking the rule attached to Tier 1 PSW?

Thank you for your reply, joh118. But I'd already seen the link before I posted my question and it doesn't say anything about Statutory Sick Pay.

Can anyone else advise please?

is statutory sick pay related to your NI contributions??? If so, you can claim it.

Hi Joh118. That's part of what I don't know about. Can anyone answer my question please? Am I going to break the immigration rule of "No recourse to Pubilc Funds" if I receive SSP?

If it is not listed in para 6 of the Immigration Rules (which it isn't) then I believe you can claim it.

SSP is related to your NI contributions and your employment history is not a public fund as defined in the immigration rules.

Although it is not listed in the benefits you can claim this list is not exhaustive. It is similar to Statutory Maternity Pay which is on the list of benefits you can claim when you have no recourse.
