Can I claim earnings & expernce if I have break in limit

Can I claim earnings & expernce if I have break in limit

Hi,

I opened a limited company in May 2010 and from then I am a employee of the limited company.

I was doing contract from May 2010 till December 2010 and from then I am looking for other contracts to say I am on bench till today.. If I get new contract in next month am I eligible to say/show to Immigration that I am working from May 2010 till November 2011?

I took my dividents in December, January and february and from then I didnt took any money till now and I am planning to take money once I ahve new contract.. Am I eligble to show my dividents as earnings whihc I took in December 2010 , January 2011 and february 2011... and also in comming months till November 2011 as consecutive 12 months salary/dividents? And the same am I eligible to claim previous experence?

You can claim earnings provided you had dividends from the profit during 12 months period. e.g if you took dividends from profits of invoices raised from dec./jan./feb month. or so. and period you are planning to claim is from dec. 10. to nov. 11.

Your accountant need to provide details of this.

If your earnings are above the minimum threshold e.g. 16000/25000 in UK depending upon your initial visa application, then you can claim for uk experience even though you had a break in your contracts duing 12 month period.

To Clarify : Is it fine to claim dividents/salaries from my limited company even I am not contracting continiously (in between 4 months of my last 12 months)...

Eg: I am applying in December 2011 and I was contracting Dec 2010 then from January 2011 till March 2011 I was not contracting... but from April 2011 till October 2011 I will be contracting.. So can I claim December 2010 and from April till October 2011??????

you can claim earnings with a break in total 12 months period as mentioned in guidance notes:

83. An applicant does not have to be in
continuous or full-time employment during the
12 months being assessed.
84. An applicant may claim for a period of
earnings of less than 12 months if they have
earned sufï¬

Thanks for your reply.. I understnad that we can show less than 12 months salary if it satisfies the points.. But my question is :

I have a break in between 12 months and wondering Am I eligible to claim that points???

Scenario is : I am a contractor.. taking Dividents and Salaries.... I am applying in December 2011.. so I wnat to show from October 2010 till October 2011.. In which I was not working Jan 2011, Feb 2011 and March 2011 and Didnt took any salaries and Dividents...

So my first question is :
I am wondering am I able to show November 2010 and December 2010 along with April 2011, May 2011, June 2011, July 2011, Aug 2011, Sep 2011, and October 2011??????

Second question is:
I am taking basic salary per month 550 and comes out yearly less than 5500 which is the less than threshold salary.. and wondering do I need to pay PAYE?????

Please advise above two questions.. Many Thanks for the seniors of this forums...
