When can I apply for BC - Please help

I got my ILR in Oct 09 and prior to that had no legal standing in the country due to having trusted a bogus solicitor with my family case and he vanished with the money and stamped our passports with a fraudulent stamp. Got a good lawyer who took our case in 07 and outside immigration rules won our case in Oct 09. My question is can we apply for BC or we have to wait and fulfill the 5 years prior rule, or we just go with the 1 year ILR rule. I just don't want to waste time applying only to be declined. Please Advise
