help on applying for spouse visa

hi let me ask some few question, as i was uk illegally and am back to my country and we are planning to marry in august as my british partner is working so that we she can have fund to support our application. what does she need or what documents does she need to prepare before she come and get married and apply for spouse visa.

second question, if visa is rejected and we appeal, and the appeal can take even 6 months if she decide to go to eu country and i join her in that country and then we win appeal will i have to go back to my country to get spouse visa.
