ILR success on 21st April WP + Tier1

ILR success on 21st April WP + Tier1

Hi
Am following the forum for the past few weeks. Recently my husband got his ILR from Birmingham PEO on 21st April. Would like to share our experience
Came to UK - 5th May on WP
Got Tier1 (G) on Oct 2009 valid until Oct 2012.
Applied for ILR on 21st April in Birmingham PEO

Mu husband was the main applicant. Me and my daughter were the 2 dependents.
Scored 80 points in the points tables. ( Tier1 before April 2010). Age -0 Qualificns- 35 ( same as before), earnings - 40 ( 5 lower than before). UK experience ( 5).
Submitted last 12 months bank statements
12 months payslips ( 2 months without pay)
Life in the UK pass certificates

We had a pleasant experience. Had appointment at 12.45. Reached at 12. Was called around 12.40. Paid the money at 1.0pm. Got passports at 4 pm.

Congratulations and thanks for sharing your experience. Did your husband provide any letter from previous employer (the employer who sponsored WP initially)?

My husband had kept the previous employment offers with him. The caseworker said that that if we had the employment letters from previous WP he can provide them as an additional evidence. Not a must.

If you have then better keep it with you.

what cohabitation documents do you provide? have you been absence abroad (dependent)? any restriction for the dependent absence? thanks

Hi
Even though we had kept co habitation evidence from six different sources for me ( dependent) surprisingly did not ask for any. I had kept the following with me
Council tax
Utility bill
Poll Card
NHS Card/ Dental hospital appointment letter/ dentist letter
My CRB certificate
My bank letter

Next I was away from UK for about 60 days in total in the last 5 years. That too the case worker did not say anything about. When I pointed out about my spreadsheet she said that she did not need that. I do not know why. I think she could see my absence on her screen.

Congrats for your ILR papiaroy

Did they ask any questions regarding the salary being lower than before

earnings - 40 ( 5 lower than before)

Yes after going thru the documents the caseworker noticed that my husband's salary was lower than what he claimed during Tier1. In fact he was without job for 2 months, so his salary band had fallen down. But as his points was well above 75 ( the min reqd to score) the caseworker said that it was fine.
My husband had shown only 10 months salary in place of 12 months.

He had kept with him a letter from his current employer stating that he is employed in this company from such and such date in the capacity of such and such ( designation). His salary is such and such.

The case worker did not ask the letter on her own but when my husband told her that he has got a letter from his employer she then wanted to see it and kept with her. The letter was later returned along with the passports.

In fact the caseworker took all the offer of employment letters also( present and past employers) and later returned them.
I think it is a good idea to keep the office letters.

Could not decide to apply by post costing £1944 or in person £2700.
Can you please put some light on this if you have already made some research on this?

Even I too was in a dilemma whether to apply by post or in person. But then I was not too sure about the time taken by post as the UKBA site says max time is 6 months which I feel is too long a time. So although the difference in fees is a hefty one still I opted for PEO.

It again depends on the need. I am travelling on the 27th of May, Hence booked my appointment on the 16th of May.

as long as there isn't any urgency; I would prefer going for postal application. Also it depends on how simple your case is :)

I think it is a good idea to ask people who have got their passports back after postal application. That should give you a rough guideline.

2) Bank statements and payslip older than 12 months
3) A covering letter

My husband had carried all of the above. He had 4 P 60s and 1 P45.
Bank statements for the last 15 months
Salary slip covering last 15 months but the caseworker took only 12 that my husband had claimed for.( Actually 10 as he did not have 12)
A very detailed covering letter mentioning all the earnings table, absence table, list of documents etc.
The caseworker did not return the covering letter

Hi congrats!! could I please check did you say yes for the following point on the SET (o) form as you applied within 28 days of the 5 years completion -

Please confirm whether you have spent a continuous period of 5 years lawfully in the United Kingdom

I would appreciate your response...

Hi Papiaroy,

Many thanks for your response.... I called today to Customer Services and the guy said that if applying with 28 days rule then do not tick that and provide a covering letter, so just confised now... Just wondering if this was suggested to tick that box by custoerm service ?

Would highly appreciate your comments on this...

No I did not call up customer service. However I informed the caseworker of that point but she did not seem to take it that seriously, just said that is fine.
