if parents got ILR and did not apply for the child born in Uk for their ILR, as to apply directly for his nationalily, what would be his status, child has a valid t2 dependent visa, valid for another 9months. if the parents wants to travel abroad urgently dont have the time to wait for nationality cert now , would there be a problem with the child coming back to uk

there are two scenarios

- apply via NCS get the aproval and apply for passport from outside (can the parents apply from outside)
- travel on the same visa and apply on return (will he be allowed back to uk)

Please advise

If the child is not registered as British citizen before the child travels, then the child may be refused entry because of your change in circumstances (321A).

Is the intended travel to the country of parents' citizenship? If so, then an application for registration as British citizen can be made at the British High Commission. Enquire with the relevant High Commission on the specifics (procedure, form, fees etc.).

ILR dependent child can get ILR directly if never came in uk

Please tell me,

If some one got ILR on Tier-1,,,after 5 Years,,,,can his dependent child apply directly ILR from other country,,even they have not accompanied
during that 5 years?


Above is for child,for spouse i think it is 2 years visa than ILR

ILR or any form of "leave to remain" can only be applied for from within the UK.

A child, born abroad, may be eligible for ILE depending on the immigration status of the parents. And if either parent is not a settled person or not being granted settlement at the same time as the child's application, then the child may not be eligible for ILE (297(i)).
