ILR for dependent child

I am on a work permit and applying for ILR in June having completed my 5 years. My husband is on a dependents visa. We entered at the same time in 2006.

Our child was born in England in 2009. We have travelled with him numerous times - he has a NZ passport only - and we got him a dependents visa whilst in New Zealand so he could get entry clearance to get back in. His dependent visa states it expires 28/6/11 (the same date as ours).

I have only just read on these boards that I may not have to apply for ILR for him as he can just get a passport as soon as we have ILR. Is this true?

We are going to apply in person in Croyden in early/mid June. Would we have to have this finalised before 28.6.11 or would be then be an 'overstayer' or something?

With the hike in prices this would be a great saving if we don't have to, but I don't want to muck this up. Thanks for any help.
